RIGHT OF WITHDRAWAL, EXCHANGES AND/OR RETURNS
At memiman, we want our customers to be satisfied with their purchases. Below, we detail the conditions applicable to exchanges and returns of products purchased through our online store, distinguishing between the legal right of withdrawal and the voluntary commercial policy for exchanges and returns offered by memiman.
1. LEGAL RIGHT OF WITHDRAWAL FOR ONLINE PURCHASES
In accordance with current regulations regarding the protection of consumers and users, when the buyer has the status of a consumer or user and makes a remote purchase through our online store, they have the right, in general, to withdraw from the purchase within a period of 14 calendar days, without needing to provide a reason.
The withdrawal period will begin to count from the day on which the consumer, or a third party indicated by them, other than the carrier, acquires physical possession of the product.
To exercise the right of withdrawal within said period, the customer must unequivocally communicate their decision to withdraw from the contract to memiman.
Communication may be made by email sent to pedidos@memiman.com indicating, preferably, the buyer's details, the order number, and the items for which they wish to exercise the right of withdrawal.
The legally provided withdrawal form may also be used via the button enabled in the online store, although its use is not mandatory.
It will be sufficient for the communication regarding the exercise of the right of withdrawal to be sent before the end of the 14-calendar-day period.
2. RETURN OF PRODUCTS AFTER WITHDRAWAL
Once the withdrawal has been communicated, the consumer must return or deliver the products to memiman without undue delay and, in any case, within 14 calendar days following the date on which they communicated their decision to withdraw.
The return may be made:
a) At our memiman boutique, with no return costs, at:

28921 Alcorcón (Madrid). Spain. EU.
b) By shipping to our store, following the instructions that we will provide upon receiving the withdrawal request.
Unless the return is the result of an error attributable to memiman or a defective or non-conforming product, the customer will bear the direct cost of returning the products.
Shipments with payment upon delivery (freight collect) will not be accepted without prior authorization from memiman.
3. CONDITION OF RETURNED PRODUCTS
The consumer may examine and handle the product only to the extent necessary to establish its nature, characteristics, and use, similar to how they would be able to do so in a commercial establishment.
The consumer will be responsible for the decrease in the value of the products resulting from handling other than what is necessary to verify their nature, characteristics, and use.
For this reason, we recommend returning products in perfect condition, without having been used beyond what is necessary for verification and, whenever possible, with their original tags, accessories, and packaging.
The absence of the original packaging or tags will not in itself imply the automatic loss of the legal right of withdrawal, without prejudice to the possibility of assessing, where legally appropriate, a potential decrease in the value of the product.
4. REFUND IN CASE OF WITHDRAWAL
When the right of withdrawal has been exercised correctly, memiman will refund the payments received corresponding to the products subject to withdrawal, as well as, where legally appropriate, the ordinary delivery costs initially paid by the consumer.
If the customer has expressly chosen a mode of delivery more expensive than the ordinary mode offered by memiman, memiman is not obligated to refund the additional costs corresponding to that special mode.
The refund will be made without undue delay and, in any case, within 14 calendar days following the date on which the decision to withdraw is communicated to us.
However, memiman may withhold the refund until the products have been received or until the consumer provides proof of their return, whichever condition is met first.
The refund will be made using the same payment method used by the customer to make the purchase, unless they have expressly agreed to another method and provided that it does not incur any additional cost.
5. LEGAL EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal will not be applicable in the cases legally established and, in particular, when it applies to:
Products made to the consumer's specifications or clearly personalized.
Sealed products that are not suitable to be returned for health protection or hygiene reasons and that have been unsealed after delivery.
Any other product or case for which current legislation expressly establishes an exception to the right of withdrawal.
When a product is personalized, made according to the customer's specifications, or is legally excluded from the right of withdrawal, memiman will expressly indicate this on the product page before finalizing the purchase.
Christening, wedding favor, ceremony, communion, and graduation garments.
The mere classification of a garment as christening, wedding favor, ceremony, communion, or graduation, does not in itself eliminate the legal right of withdrawal when it is a standard product purchased online.
However, when such garments have been made, modified, or ordered according to the customer's specifications, are clearly personalized, or any other legal exception to the right of withdrawal exists, such right will not be applicable under the terms provided by current legislation.
All of this is understood without prejudice to memiman's voluntary commercial policy, which is regulated below.
MEMIMAN'S COMMERCIAL EXCHANGE POLICY
6. VOLUNTARY EXTENSION UP TO 30 DAYS (15 DAYS DURING SALES)
Independently of the aforementioned legal right of withdrawal, memiman voluntarily offers its customers the possibility of making certain exchanges within a maximum period of 30 calendar days from the date of purchase. During periods expressly identified as SALES, said commercial period will be 15 calendar days from the date of purchase.
This extension constitutes a voluntary commercial benefit offered by memiman and does not replace, limit, or modify the rights that legally belong to the consumer.
Once the legal withdrawal period has ended, exchanges requested within this additional commercial period will be subject in full to the conditions and exclusions indicated below.
7. CONDITIONS FOR EXCHANGES
Within the aforementioned commercial period, an exchange may be requested for another available size or color of the same model, provided that:
The product has not been used.
It is in perfect condition.
It has not been washed, altered, or handled.
It retains its original tags.
It retains its accessories and, where applicable, its original packaging.
It is not included in any of the exclusions indicated in the following section.
If the customer wishes to replace the product with a different model or item, they must make a new purchase, with the conditions corresponding to the legal right of withdrawal or, where applicable, the current commercial policy, applying to the return of the original product.
8. PRODUCTS EXCLUDED FROM THE COMMERCIAL EXCHANGE EXTENSION
Once the legal withdrawal period has elapsed, the voluntary commercial extension up to 30 days offered by memiman will not be applicable to:
Christening garments and items.
Wedding favor garments and items.
Ceremony garments and items.
Communion garments and items.
Graduation garments and items.
Items personalized or made according to the customer's specifications.
Underwear.
Hosiery.
Hair accessories.
Items specially requested or ordered for the customer without prior stock.
Those products whose product page expressly indicates that they are excluded from the commercial exchange extension, always respecting the rights that legally correspond to the consumer.
These exclusions refer exclusively to memiman's voluntary commercial policy and cannot be interpreted as a limitation of the inalienable rights recognized to the consumer by legislation.
9. HOW TO REQUEST AN EXCHANGE
To request an exchange, you must write to pedidos@memiman.com indicating:
Buyer's name.
Order number and date.
Item you wish to exchange.
New size or color requested.
We will confirm availability and provide the necessary instructions to carry out the exchange.
Transportation costs derived from exchanges made under this voluntary commercial policy will be borne by the customer, unless the exchange is due to an error by memiman or a lack of conformity of the product.
The exchange can also be made in person at our boutique, provided that the above conditions are met and proof of purchase is presented in paper or electronic format. In this case, transportation costs will not apply.
DEFECTIVE, INCORRECT, OR NON-CONFORMING PRODUCTS
10. PRODUCTS WITH LACK OF CONFORMITY
The previous conditions regarding withdrawal and commercial exchanges do not affect the legal rights of the consumer when the product received is defective, incorrect, or does not conform to the contract.
If you receive a defective, damaged, or incorrect item that does not correspond to the order placed, you must contact us as soon as possible via pedidos@memiman.com indicating the order number and describing the incident. We may request photographs or other information reasonably necessary to verify it.
When there is a lack of conformity attributable to memiman, the measures and guarantees established by current regulations will apply, at no cost to the consumer in the legally provided cases.
