RIGHT OF WITHDRAWAL, CHANGES AND/OR RETURNS

At memiman, we want our customers to be satisfied with their purchases. Below are the conditions applicable to changes and returns of products purchased through our online store, differentiating between the legal right of withdrawal and the voluntary commercial policy for changes and returns offered by memiman.

1. LEGAL RIGHT OF WITHDRAWAL FOR ONLINE PURCHASES

In accordance with current regulations on consumer and user protection, when the buyer is a consumer or user and makes a distance purchase through our online store, they will generally have the right to withdraw from the purchase within 14 calendar days, without needing to state a reason.

The withdrawal period will begin from the day the consumer, or a third party indicated by them, other than the carrier, acquires physical possession of the product.

To exercise the right of withdrawal within this period, the customer must unequivocally communicate their decision to withdraw from the contract to memiman.

The communication can be made via email to pedidos@memiman.com indicating, preferably, the buyer's details, the order number, and the items for which they wish to exercise the right of withdrawal.

The legally provided withdrawal form can also be used, via the enabled button in the Online Store, although its use is not mandatory.

It will be sufficient for the communication regarding the exercise of the right of withdrawal to be sent before the end of the 14-calendar-day period.

2. RETURN OF PRODUCTS AFTER WITHDRAWAL

Once withdrawal has been communicated, the consumer must return or deliver the products to memiman without undue delay and, in any case, within 14 calendar days following the date on which they communicated their decision to withdraw.

Returns can be made:

a) At our memiman boutique, with no return costs, at:

b) By shipping to our store, following the instructions we will provide upon receipt of the withdrawal request.

Unless the return is due to an error attributable to memiman or a defective or non-conforming product, the customer will bear the direct cost of returning the products.

Cash-on-delivery shipments will not be accepted without prior authorization from memiman.

3. CONDITION OF RETURNED PRODUCTS

The consumer may examine and handle the product only to the extent necessary to establish its nature, characteristics, and use, in a similar way to how they would do so in a commercial establishment.

The consumer will be responsible for any decrease in the value of the products resulting from handling other than that necessary to check their nature, characteristics, and use.

For this reason, we recommend returning products in perfect condition, without having been used beyond what is necessary for inspection and, whenever possible, with their labels, accessories, and original packaging.

The absence of original packaging or labels will not, in itself, entail the automatic loss of the legal right of withdrawal, without prejudice to the possibility of assessing, when legally appropriate, a potential decrease in the value of the product.

4. REFUND IN CASE OF WITHDRAWAL

When the right of withdrawal has been correctly exercised, memiman will refund the payments received corresponding to the products subject to withdrawal, as well as, when legally applicable, the ordinary delivery costs initially paid by the consumer.

If the customer had expressly chosen a more expensive delivery method than the ordinary method offered by memiman, the latter is not obliged to reimburse the additional costs corresponding to that special method.

The refund will be made without undue delay and, in any case, within 14 calendar days following the date on which we are informed of the decision to withdraw.

However, memiman may withhold the refund until the products have been received or until the consumer provides proof of their return, whichever condition is met first.

The refund will be made using the same payment method used by the customer to make the purchase, unless the customer has expressly agreed to another method and provided that this does not incur any additional costs for them.

5. LEGAL EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal will not apply in the legally established cases and, in particular, when it is applicable to:

           Products made to consumer specifications or clearly personalized.

           Sealed products that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery.

           Any other product or situation for which current legislation expressly establishes an exception to the right of withdrawal.

           When a product is personalized, made to customer specifications, or is legally excluded from the right of withdrawal, memiman will expressly indicate this in the product description before finalizing the purchase.

            Baptism, ring bearer, ceremony, communion, and graduation garments.

The mere classification of a garment as baptism, ring bearer, ceremony, communion, or graduation, does not in itself eliminate the legal right of withdrawal when it is a standard product purchased online.

However, when such garments have been made, modified, or ordered according to customer specifications, are clearly personalized, or any other legal exception to the right of withdrawal applies, said right will not be applicable under the terms provided by current legislation.

All this is understood without prejudice to memiman's voluntary commercial policy, which is regulated below.

MEMIMAN'S COMMERCIAL EXCHANGE POLICY

6. VOLUNTARY EXTENSION UP TO 30 DAYS (15 DAYS DURING SALES)

Regardless of the legal right of withdrawal indicated above, memiman voluntarily offers its customers the possibility of making certain exchanges for a maximum period of 30 calendar days from the date of purchase. During periods expressly identified as SALES, this commercial period will be 15 calendar days from the date of purchase.

This extension constitutes a voluntary commercial advantage offered by memiman and does not replace, limit, or modify the rights legally corresponding to the consumer.

After the legal withdrawal period, exchanges requested within this additional commercial period will be fully subject to the conditions and exclusions indicated below.

7. CONDITIONS FOR EXCHANGES

Within the commercial period indicated above, an item can be exchanged for another available size or color of the same model, provided that:

            The product has not been used.

            It is in perfect condition.

            It has not been washed, altered, or manipulated.

            It retains its original labels.

            It retains its accessories and, whenever applicable, its original packaging.

            It is not included in any of the exclusions indicated in the following section.

If the customer wishes to replace the product with a different model or item, they must make a new purchase, with the conditions applicable to the return of the original product depending on the legal right of withdrawal or, where appropriate, the current commercial policy.

8. PRODUCTS EXCLUDED FROM THE COMMERCIAL EXCHANGE EXTENSION

Once the legal withdrawal period has expired, the voluntary commercial extension of up to 30 days offered by memiman will not be applicable to:

            Baptism garments and items.

            Ring bearer garments and items.

            Ceremony garments and items.

            Communion garments and items.

            Graduation garments and items.

            Personalized items or items made to customer specifications.

            Underwear.

            Hosiery.

            Hair accessories.

            Items specially requested or ordered for the customer without prior stock.

            Products whose description expressly indicates that they are excluded from the commercial exchange extension, always respecting the rights legally corresponding to the consumer.

These exclusions refer exclusively to memiman's voluntary commercial policy and cannot be interpreted as a limitation of the inalienable rights recognized by law to the consumer.

9. HOW TO REQUEST AN EXCHANGE

To request an exchange, you must write to pedidos@memiman.com indicating:

           Buyer's name.

           Order number and date.

           Item you wish to exchange.

           New size or color requested.

We will confirm availability and provide the necessary instructions for the exchange.

Transportation costs derived from exchanges made under this voluntary commercial policy will be borne by the customer, unless the exchange is due to an error by memiman or a lack of conformity of the product.

The exchange can also be made in person at our boutique, provided that the above conditions are met and proof of purchase is presented in paper or electronic format. In this case, no transportation costs will apply.

DEFECTIVE, INCORRECT OR NON-CONFORMING PRODUCTS

10. NON-CONFORMING PRODUCTS

The above conditions regarding withdrawal and commercial exchanges do not affect the consumer's legal rights when the received product is defective, incorrect, or not in conformity with the contract.

If you receive a defective, damaged, incorrect item, or an item that does not correspond to the order placed, you must contact us as soon as possible via pedidos@memiman.com indicating the order number and describing the incident. We may request photographs or other reasonably necessary information to verify it.

If there is a lack of conformity attributable to memiman, the measures and guarantees established by current regulations will be applied, at no cost to the consumer in legally foreseen cases.

11. MODIFICATIONS TO THIS POLICY

memiman may modify this Exchange and/or Return Policy when necessary to adapt it to legislative, jurisprudential, technological changes, in the services used or in the operation of the store.

When changes are relevant, reasonable measures will be taken to inform users when necessary.

The current version will be the one published on this page, indicating its last update date.
